A Rowan County Sheriff’s Office deputy stopped a tan 1979 Chevrolet just before 11 a.m. last Thursday in the 5800 block of Old Mocksville Road after the driver drove over the center line. When the officer approached the car to speak with the driver, he could smell alcohol coming from the vehicle.

The deputy asked the driver, later identified as Tommy Vivian Barber, if he’d been drinking and he initially responded no, but later said he had the night before. The passenger was identified as Tina Marie Sprague. Upon searching, the driver had no warrants, but Sprague had warrants for felony breaking and entering, felony larceny and felony obtaining property by false pretenses from Salisbury Police.

The deputy found a bag in the back seat that belonged to Sprague that contained an opened bottle of vodka and an opened bottle of brandy was found in the back seat. Barber said the alcohol belonged to him.

Barber gave a positive reading for alcohol on the breathalyzer test on the scene and later at the police department, which calculated 0.02, less than 0.08 legal limit. A magistrate found no probable cause to charge Barber. He was issued a citation for having an open container of alcohol in the vehicle and released.

Sprague was also issued a citation for having an open container of alcohol. She was issued a $10,000 secured bond for the felony charges. She has since been released.
